MTA mechanic paralyzed by deadly derailment suing for $100 million

A Metro-North Railroad mechanic says he was paralyzed in the deadly commuter train derailment in New York City and is suing for $100 million.

Samuel Rivera of Ossining and his wife allege negligence by Metro-North and its parent agency.

The lawsuit says Rivera, a passenger on the train that derailed Dec. 1, suffered injuries including spinal cord damage that resulted in quadriplegia.

Four people were killed and more than 70 injured in the derailment near a station in the Bronx. Investigators say the train was going 82 mph as it hit a curve with a 30 mph speed limit.

A railroad spokesman said Wednesday that he could not comment because the lawsuit is pending.

He said seven lawsuits and 80 notices of claim have been filed stemming from the derailment.
