ON THIS DAY in 1907, the Brooklyn Daily Eagle published an article titled “Law and Precedent Ignored by the Mayor.” The article focused on the then-mayor refusing a proposal by Controller Metz.

“The astonishing attitude of Mayor McClellan in refusing to permit the Board of Estimate yesterday to consider the letter of Controller Metz on the elevated loop plan is becoming fully appreciated to-day,” the Eagle reported.  “It appears now that the ruling of the mayor was in defiance of one of the provisions of the Rapid Transit act, which expressly states that the local city authorities … have the right to request the Rapid Transit Commission, in writing, to consider any plan for rapid transit.”
