The Brooklyn district attorney has affirmed the conviction in the 2003 murder of a Fairfield University student.

Mark fisher, a college football player from New Jersey, was killed on Oct. 11, 2003 after a night of partying that started in Manhattan and ended in Prospect Park in Brooklyn.

One of the two suspects, John Giuca, always maintained his innocence.

His attorney last year filed a petition with District Attorney Kenneth Thompson citing “flimsy” evidence and noting that three witnesses had recanted their testimony.

He says he will seek a new trial.

Thompson told The New York Times that Giuca got a fair trial. He said the result was based on the evidence presented.

Since taking office last year, Thompson has affirmed 21 convictions after reviewing questionable convictions.
