In this courtroom sketch, Hon. Laura Jacobson listens as plaintiff’s attorney Mark M. Basichas (standing), of the law firm Mark M. Basichas & Assocs., PC, makes an opening statement to the jury in the medical malpractice trial Shamayeva v. Chusid, Zilber, and All Health Diagnostic Treatment

The plaintiff’s attorney told the jury of his client’s allegation that the defendants were negligent when they failed to render a timely diagnosis of stomach cancer for the elderly Russian patient who succumbed to the disease. Defendants’ attorney John A. Orbon (seated, right), of the law firm Amabile & Erman, PC, resolutely denied any departure from accepted medical standards, remarking that the patient presented with only hiccups, a symptom not associated with gastric cancer, nor for which risky biopsies were indicated before the symptoms progressed to the ultimately incurable stage years later.

The first witnesses were scheduled to appear this week in the trial that continues in Kings County Civil Term.
