Brooklyn Bar hosts pair of elder law attorneys for CLE course

The Brooklyn Bar Association hosted a pair of elder law attorneys for a Continuing Legal Education (CLE) course titled “Nursing Home Litigation Under the Public Health Law: Identifying Elder Abuse and What To Do About It” at a meeting on Remsen Street Thursday.

John Dalli and Jeanne Ramasso, both from Dalli & Marino, LLP, led a two-hour course and discussion on nursing home litigation. They focused on how to identify elder abuse and neglect in nursing homes as well as at home by health aides and what attorneys can do for their clients.

“The population, not only of Brooklyn, but the entire country, is aging rapidly,” Dalli said. “We have more seniors that are going to need care both in nursing homes and at home with home health care, so these are relevant issues for many lawyers.”

Dalli said attorneys need to be educated on the proper rules and regulations of nursing homes and assisted living facilities as well as the rights of their patients. They also need to know the rules regarding placement and reimbursement at nursing homes.

“If something does happen in a nursing home that is inappropriate and they are hurt or are injured, [the client needs to know] that they do have rights, a cause of action and can seek redress in the courts to right those wrongs,” Dalli said.

“There are also things they can do to prevent bad results from occurring in the nursing home. We talk about what to look for and what to ask,” he continued. “It’s to help ensure that elderly people don’t get injured, hurt and abused in nursing homes.”
