In this courtroom sketch, Hon. Marsha Steinhardt listens as plaintiff’s attorney David L. Taback (standing) conducts a cross-examination of the defendant in the medical malpractice trial Estrella v. Tehrani. Also from Taback’s law office is attorney Jennifer Fleming (seated, left). Court reporter Cheryl Lorient (seated, center) transcribes the proceedings.

The plaintiff was a 23-year-old outpatient when she underwent a bilateral flank liposuction in July 2006. At issue in the trial is the plaintiff’s contention that her care in the period after the surgical procedure was poorly managed. She is alleging that her complaints, including symptoms that she claims are consistent with post-op infection, should have resulted in more investigation and intervention.

The trial continues this week in Kings County Civil Term. Attorney Gerard Marulli (seated, far right), of the law firm Marulli, Lindenbaum & Tomaszewki, represents the defendant.
