SKETCHES OF COURT: Jury returns verdict for defendant in car accident damages trial

Maya Berg was behind the wheel when she caused the two-car collision involving Albina Masgudov, at the intersection of Cass Place and Corbin Place in Brooklyn in June 2013. Masgudov, 60, was transported from the accident site by ambulance. Berg conceded liability, and was represented by Brian McCall (at right), of the law firm DeCicco, Gibbons & McNamara. 

Deliso reminded the jury via evidentiary photography supporting his contention of a reckless accident and resultant heavy impact, that Masgudov should be justly compensated for her claims of severe injury to her back, neck and left shoulder in the accident for which she bore no responsibility. Masgudov maintained that she can no longer walk the three blocks it would take to visit her grandchildren. 

McCall vigorously maintained that there were no neurological findings by his doctor. 

The jury returned a verdict for the defendant, failing to find that Masgudov’s claims met the serious injury threshold in the trial that concluded last week in Kings County Civil term.
