SKETCHES OF COURT: Jury finds no fault for defendant in car accident trial

The parties differed in their accounts of the June 2009 collision on Paerdegat Avenue. Alexandre Dorgelan testified that he had seen the defendant’s car behind him. After he initiated a left turn onto Paerdegat 2nd Street, he felt a heavy impact on the driver’s side of his car. Fields attempted to enter photographs of the impact damage location into evidence, but they were not exchanged in advance of the summary jury trial and thus were excluded. 

Cheryl McKenzie testified that it was Dorgelan’s car that hit hers, and alleged to have been driving to his left and not behind him. She had not seen his car before the accident. Her vehicle subsequently careened into a tree “and was totaled,” but she did not recall if there was any damage to her passenger side rear door. 

The jury deliberated three hours before finding no fault on the part of the defendant in the trial that took place this week in Kings County Civil Term.
