SKETCHES OF COURT: Parties settle for confidential sum in podiatric medical malpractice trial

In 2007, Lystra Tannis, 65, sought treatment for a painful bunion and underwent a surgical procedure by Dr. Peter Mollica, a specialist in the field. He was represented by Michael Sullivan (at right), of the law firm Heidell, Pittoni, Murphy & Bach.
Friedman claimed that Mollica was negligent and departed from accepted standards of podiatric care when he diagnosed and performed a Keller Bunionectomy, in that the surgery did not achieve the desired outcome. Tannis subsequently developed a hammertoe. Sullivan maintained that Mollica performed the procedure properly and that the hallux hammertoe which Tannis addressed 28 months later via fusion surgery with instrumentation was a separate issue.
The parties settled for a confidential sum without any admission of fault or liability in the trial that concluded last week in Kings County Civil Term.
