SKETCHES OF COURT: City settles trial in spare tire incident

In July of 2013, Luis Scaduto was working at the New York City Department of Sanitation’s (DSNY) garage facility on Hamilton Avenue. Scaduto, in his capacity as DSNY supervisor, came upon a truck tire that was out of place. He was then felled by the freestanding, 4-foot, 350-pound tire when it tipped over. 

Scaduto was represented by Jason Herbert (second from left), of the law firm Krentsel & Guzman, who claimed that his client sustained serious injury due to the city’s negligence in its failure to maintain and protect its premises from a dangerous condition.

The jury determined that liability fell equally on both parties. The matter was resolved before the damages phase with a settlement of $15,000 in the trial that ended this week in Kings County Civil term. Court reporter Mike Capuano (at left) recorded the proceedings.
