SKETCHES OF COURT: Jury awards plaintiff $250K in car accident trial

In this courtroom sketch, Hon. In December of 2012, Gennady Aybinder had an unfortunate confluence of time and place when he chose the moment to affix a replacement license plate to his car. John Katsomaliaris, a driver for PJ Gotham Transportation, lost control of his Lincoln Town Car and rear-ended the parked vehicle in front of which Aybinder had been kneeling. Edward Averbuch (at right), of the law firm Leav & Steinberg, represented Aybinder. Averbuch moved for and was granted a directed verdict on liability. 

Aybinder, 40, claims to have injuries and pain as a result of the accident that significantly impact his life. After 16 months of physical therapy, his treating physician maintained that Aybinder had reached the maximum resolution of his lumbar herniation and radiculopathy, and that his condition was permanent.

Corring maintained that studies indicated Aybinder’s herniation predated the accident. However, the jury found in favor of Aybinder and awarded him $100,000 for past and $150,000 for future pain and suffering in the trial that concluded last week in Kings County Civil Term. Court reporter Lisa Matzel (at right) recorded the proceedings.
