Victim of court officer accused of forcing her to perform sex act speaks out

After a Brooklyn court officer was indicted Monday for allegedly forcing a woman to perform a sex act on him, the victim publicly spoke out.

“I think he definitely should go to jail,” Erica McRae, 26, told reporters. “This is something that shouldn’t have happened.”

McRae, a stay-at-home mom for a 4-year-old and twins on the way, was waiting in Brooklyn Criminal Court to bail her boyfriend out on Oct. 21, 2016 when Sgt. Timothy Nolan walked up to her.

Nolan, 58, allegedly led McRae to a nearby stairway, grabbed her from behind, unzipped his pants and exposed himself, according to court documents.

He allegedly blocked the exit door with his back and masturbated in front of her, repeatedly telling her to “spit on it.”

When McRae tried to escape down the stairwell, Nolan reportedly forced her to touch his penis, according to court filings.

McRae was allegedly made to believe Nolan would help or hurt her boyfriend’s case, dependent on the sex act.

Nolan, a 10-year court veteran, was transferred to Bronx Criminal Court but has been on unpaid suspension since November, according to the Office of Court Administration.

He was released without bail by Supreme Court Justice Danny Chun at Brooklyn Supreme Court on Monday.

McRae said she has been mostly confined to her Long Island home since the incident.

“I was scared to go back to court,” McRae said. “I don’t like to see other officers; I don’t like to be around them.”

McRae’s attorney, Sanford Rubenstein, is looking to get a criminal trial.

“Let this stand as an example that if one abuses the power of authority that they have, commits a criminal act, they will be held accountable in our system of justice and perhaps they will end up in jail themselves,” Rubenstein said.

Nolan faces up to a year in jail on the top charge.

“I don’t want this to happen to anybody else,” McRae said. “Especially in a court system.”

Nolan was charged with official misconduct, public lewdness, exposure of a person and second-degree coercion.

He is expected to appear back at Brooklyn Supreme Court on Oct. 4.
