Appellate Division preserves prior order to keep LICH open
The Appellate Division, 2nd Department has dismissed a request for stay filed by the State University of New York-Downstate (SUNY) in its ongoing effort to close Brooklyn’s Long Island College Hospital (LICH).
In September, Brooklyn Supreme Court Justice Johnny Lee Baynes issued an order finding SUNY’s closure plan for the LICH to be invalid, that the state regulations governing hospital closures were unconstitutionally vague, and that the Department of Health did not take the needs of the community into consideration when it approved SUNY Downstate’s plan to close LICH.
SUNY filed an appeal and a request for a stay of Baynes’ order, and the Appellate Division issued a ruling last Thursday ordering that Baynes’ September order remain intact and continued.
