Firefighter teams up with Court Street attorney vs. Yankees

COURT STREET — A retired firefighter who is suing the Yankees held a press conference this week in Downtown Brooklyn, claiming the stadium shouldn’t have served his alleged assailants any more alcohol.

Court Street attorney Sanford Rubenstein and his client, former FDNY Lt. Richard Kelly, say the team is guilty of negligence for Kelly’s injuries sustained during the May 11 game at Yankee Stadium.

Kelly says he was grabbed in a chokehold, thrown down and kicked in the side after objecting when one of two intoxicated brothers sat in his son’s seat.

“A baseball game is attended by families who enjoy the experience of watching a sporting event at a stadium together,” Rubenstein said at Wednesday’s press conference at 16 Court St. “To have one member of a family attacked by intoxicated fans who it appears was served beers by stadium vendors after they were already intoxicated is inexcusable and unacceptable.”

Kelly filed the lawsuit Tuesday in Bronx Supreme Court.

He says he suffers from concussion-like symptoms.

Kelly says Brad Stamler and his brother Keith were served drinks after they already were intoxicated. The two are charged with assault.

Brad Stamler did not immediately respond to a call for comment to his New Jersey office.

The Yankees won the game 6-2 against the Seattle Mariners.
