Williamsburg Food Co. Sued by Government

WILLIAMSBURG — The U.S. Department of Labor has filed suit in Brooklyn federal court against Grace Food Distribution Inc., 77-81 N. 1st Street, and company president Ben Kwong C. Chiu, alleging willful violations of the recordkeeping provisions of the federal Fair Labor Standards Act (FLSA).

“In this case, these defendants have repeatedly and willfully obstructed our efforts to determine if the company is in compliance with the FLSA,” said Philip Jacobson, director of the Wage and Hour Division’s district office in New York City. “They have failed to keep accurate records indicating the name and address of each employee, as well as the hours worked by each and the amounts paid to each employee.”

The Labor Department’s suit against the Williamsburg food distributor asks the U.S. District Court for the Eastern District of New York to issue an injunction ordering the defendants to stop violating the recordkeeping provisions of the FLSA now and in the future, and to pay the department’s court costs for bringing this action.

Jacobson added, “This action should put employers on notice that they cannot avoid their legal responsibilities to pay their employees properly simply by ignoring the basic record-keeping requirements of the FLSA. This should make it clear that we will not hesitate to take to court any employer who so brazenly flouts the law.”
