A sanitation worker from Brooklyn got to return home to his family the day after Christmas when a judge denied a prosecutor’s request for $1,500 bail on Tuesday during his arraignment for hitting a woman in the head with an empty plastic bottle in a Christmas-night parking spot feud.

“All my client is accused of doing is hitting the complainant with an empty plastic Snapple bottle,” said defense attorney Sharmeen Mazumder, arguing for Robert Leslie to be released without bail.

Leslie, 33, was brought into court in handcuffs after his Christmas arrest. He is charged with misdemeanor assault, menacing, weapon possession and a harassment violation, according to court documents.

Brooklyn Criminal Court Judge Keshia Espinal released him and issued an order of protection against the victim, who was a stranger to Leslie.

When Leslie and his girlfriend allegedly blocked a parking spot behind 2915 West 5th St., a Trump Village building in West Brighton, the woman drove up trying to park. The girlfriend then allegedly began fighting the other woman and punched her face before Leslie hit her with his bottle, prosecutors said.

The woman called the police and was treated at Coney Island Hospital for bruising and swelling of the face, police said.

All three were charged with misdemeanors.

Mazumder cited Leslie’s clean criminal record and Department of Sanitation job of over a decade as proof of his responsibility to return to court.

He faces a max of up to one year in jail on the assault charge.

The Sanitation Department told the Brooklyn Eagle that it is investigating the situation and will decide whether or not to suspend Leslie when its investigation is concluded.
