Man gets 5 years for rape of 9-year-old girl

A 30-year-old man was sentenced to five years in prison at Brooklyn Supreme Court on Monday after he pleaded guilty to sexually penetrating a 9-year-old girl and punishing her and her siblings by taping them to a wall.

With no parties having anything to say on behalf on Phillip Payne, Supreme Court Justice Miriam Cyrulnik swiftly dealt the promised five-year sentence with 13 years’ supervised post release.

Payne pleaded guilty to sexual conduct with a child on Jan. 19, 2018 to secure the sentence. He was also charged with unlawful imprisonment and endangering the welfare of a child.

A criminal complaint shows that while the girl was sleeping at home with her siblings in Dec. 2016, Payne entered the room, pulled her clothes down and penetrated her.

When she told him to stop because it hurt, he reportedly told her, “shhh,” according to the complaint.

He engaged in similar acts multiple times between Sept. 9, 2015 and Dec. 26, 2016, according to his indictment.

In addition as a punishment, Payne would tell the children to stand against the wall with their arms stretched out so he could duct tape them up. If they dropped their arms, he would hit them, the complaint details.
