Contractor sues Fortis on LICH-related condo project

ICS Builders, a New York City contractor, is suing Brooklyn-based Fortis Property Group for $3.4 million, as well as interest, costs and fees, in connection with the conversion of a former Long Island College Hospital building in Cobble Hill into luxury condos.

Fortis hired ICS in July 2016 after LICH had closed its doors. In the lawsuit, according to Construction Dive, ICS said it was supposed to complete the project by Nov. 10, 2017, but was prevented from doing so because of delays caused by Fortis, the architect and other parties to the project. ICS also claimed it was unable to access the worksite, that plans and specifications were deficient and that applications to the city Department of Buildings were improper, Construction Dive said. ICS said it had made substantial progress on the conversion project until Fortis sent it a termination letter on Aug. 9, effective Aug. 31.

ICS asked the court to stop Fortis from terminating its construction contract and to prevent Fortis from making a claim against ICS’ performance bond, which would negatively affect ICS’ business.
